Terms of Service

v1.1 introduces the Bookify Directory (Part D) and updates the status of Bookify’s public listing, ranking and claiming arrangements. All registered clients were informed of these changes before they took effect. The previous version (v1.0) is archived and available on request from legal@bookify.mt. See the version history at the foot of this page.
These Terms of Service (“Terms”) form a legally binding agreement between you and the operator of Bookify Malta. By creating an account, or by accessing or using the Bookify Malta platform at bookify.mt or any app we provide (together, the “Service”), you agree to these Terms. If you do not agree, please do not use the Service.
The Service is provided in three capacities: as a subscription-based software platform for business owners (Part B), as a self-booking tool for your clients (Part C), and as a public business directory of salons, barbers and beauty businesses in Malta and Gozo (Part D). Some Terms apply to everyone (Parts A, E, F). Read the parts that apply to your role. An unclaimed directory listing is not an agreement between the listed business and Bookify Malta (see Part D).
Part A — General
A.1 Who we are
The Service is operated by Christian Azzopardi, trading as Bookify Malta (“Bookify Malta”, “we”, “us”, “our”):

A.2 Eligibility
You must be at least 16 years old to create a Bookify Malta account. By registering you confirm you meet this requirement. Business owners must additionally be lawfully entitled to operate the business they list and must hold any licence, permit or insurance required for the services they advertise.
A.3 Your account
You agree to:
- Provide accurate, current and complete information about yourself and your business;
- Keep your password secure and not share it with anyone;
- Notify us promptly at info@bookify.mt if you suspect unauthorised access;
- Be responsible for all activity that occurs under your account, including any staff accounts you create.
A.4 Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent or abusive purpose;
- Create fake accounts, fake bookings or fake reviews;
- Harass, threaten or impersonate any user, business or staff member;
- Upload content that is illegal, defamatory, infringes a third-party right or violates anyone’s privacy;
- Reverse-engineer, decompile, scrape or attempt to extract source code or data from the Service;
- Interfere with, disrupt or place undue load on our systems;
- Use the Service to send unsolicited commercial messages;
- Bypass any technical safeguard, rate-limit or access control.
Violations may result in immediate suspension or termination of your account without refund.
A.5 Content you post
You retain ownership of the content you upload (business name, services, categories, photos, client notes). By posting content you grant Bookify Malta a worldwide, non-exclusive, royalty-free licence to host, display and reproduce that content strictly for the purpose of operating and providing the Service to you. We may remove any content that violates these Terms or applicable law.
A.6 Intellectual property
The Bookify Malta name, logo, platform software, design and trademarks are owned by Christian Azzopardi, trading as Bookify Malta. We grant you a limited, revocable, non-transferable, non-exclusive licence to use the Service for its intended purpose during your subscription. No other rights are granted by implication or otherwise.
A.7 Account deletion
You may delete your account at any time. How to do it, what we delete and what we keep is set out in our Account Deletion Policy.
A.8 Privacy
Our processing of personal data is governed by our Privacy Policy (for the marketing website) and Platform Privacy Policy (for the platform). By using the Service you acknowledge that you have read them. For the personal data of your own clients processed through Bookify Malta, our Data Processing Agreement forms part of these Terms.
Part B — Business owners (subscribers)
B.1 What the subscription provides
Business owners receive access to a SaaS platform for managing self-booking requests, a live calendar, client records, services and categories, staff accounts, SMS reminders (an add-on on paid plans), two-way reschedules, revenue and booking statistics, and other features depending on your chosen plan. Current features per plan are described on our Pricing page.
B.2 Free trial
Every new business account receives a free 3-month trial of the Pro feature set. No payment method is required to start the trial. At the end of the trial you must choose and subscribe to a paid plan to continue using Pro features. If you do not subscribe, your account reverts to the free Basic plan. Existing bookings already in your calendar will continue to work and be honoured.
B.3 Plans and pricing
We offer the following subscription tiers, billed monthly or annually. All prices are exclusive of Maltese VAT. 18% Malta VAT is added on top of the listed price and itemised on every invoice.

Pro is free for the first 3 months (see B.2) and reverts to the free Basic plan at trial expiry unless you subscribe to a paid plan. Enterprise is sold out May–October. This table is generated from the same pricing configuration that powers our Pricing page. If a price shown here ever differs from the price displayed on our website or at checkout, the price displayed at the time you accept the subscription governs.
Pricing may change with at least 30 days’ prior notice by email. Price changes do not apply to an already-paid billing period. You always have the option to cancel before the new price takes effect.
B.3.1 Additional charges — staff seats, locations and SMS
In addition to the plan subscription in B.3, the following optional charges may apply. These rates are generated from the same pricing configuration used on our Pricing page and cost calculator. All prices are exclusive of 18% Maltese VAT.

- When charges begin. Additional staff seats, additional locations and the SMS add-on are charged from the date they are activated, pro-rated for the remainder of the current billing period.
- When they stop. When you remove a staff seat or location, or deactivate the SMS add-on, the corresponding charge stops at the end of the then-current billing period. Removing an add-on never deletes client data or bookings.
- Annual discount. The 2-months-free annual discount applies to the plan subscription only. Additional staff seats, additional locations and SMS usage are billed monthly at the rates above, even on an annual subscription, and are not covered by the annual discount.
- VAT. 18% Malta VAT is added to every subscription and add-on charge and is itemised separately on each invoice.
Pro includes a flat €10/mo SMS add-on with 50 free messages per month; Business and Enterprise include 100 free messages per month. Messages beyond the allowance are charged at €0.10 each. SMS usage is never charged without the add-on being active.
B.4 Billing
Subscriptions are billed in advance. We invoice paid plans and send invoices to the billing email on your account. Payment terms are stated on each invoice. Annual plans are invoiced once per year, monthly plans once per month, on or around the calendar date of your original subscription.
Bookify Malta does not charge per-booking fees, success fees or commissions on individual bookings, and there are no lock-in contracts. The charges that may apply are your selected subscription, optional SMS add-on and excess SMS usage, additional staff accounts, additional locations, and any separately agreed custom services. All charges are shown exclusive of VAT before you commit to them.
B.5 Payment failures and grace period
If an invoiced payment is not received by the due date, we will email you at intervals during a 14-day grace period. During the grace period your business remains visible and bookings remain open. After 14 days of unpaid status your business may be hidden from public booking links and new bookings disabled until the outstanding amount is settled, at which point full access is restored. We will never cancel existing bookings already on your calendar because of a billing issue.
B.6 Cancellation
You may cancel your paid plan at any time by emailing info@bookify.mt with the account email address. Cancellation takes effect at the end of the current billing period and you keep full access until then. There are no cancellation fees and no minimum terms. Refunds are governed by our Cancellation & Refund Policy.
B.7 Plan changes
You may upgrade or downgrade plans at any time by contacting us. Charges are pro-rated. Where a downgrade reduces feature access, certain content may become inaccessible: for example, downgrading from Business to Pro may reduce your available feature set. Your data is not deleted on downgrade and is restored if you upgrade back within 12 months.
B.8 Right to withdraw (EU consumer rules)
Bookify Malta’s business-owner subscription is offered for business use by sole traders, partnerships and companies acting in their commercial or professional capacity. The 14-day right of withdrawal under the EU Consumer Rights Directive (2011/83/EU) and Maltese Consumer Rights Regulations (S.L. 378.17) is intended to protect consumers, not businesses.
Acting in commercial capacity. By subscribing as a business owner you represent that you are acting in the course of your trade, business, craft or profession and not as a consumer. Where you have provided a Malta or EU VAT number at the time of subscription, that is treated as strong evidence of your commercial capacity.
Nothing in this clause removes your statutory consumer rights if, as a matter of fact and law, you in fact subscribe predominantly for personal use. You remain free to demonstrate consumer status with evidence, in which case the mandatory consumer protections of Maltese and EU law apply. Where, despite the above, consumer withdrawal rights apply and you consented to immediate performance of the Service on activation of your account, your right of withdrawal is preserved and you may be liable for a proportionate amount for the Service supplied up to the date of withdrawal.
Goodwill exception — first-time annual subscribers. Notwithstanding the above, if you are subscribing for the very first time to an annual plan, you may request a full refund of the annual fee within 14 days of the original charge by emailing info@bookify.mt. This goodwill window applies only to your first ever annual subscription and if you have not made more than 5 bookings through the Service during the 14-day window. After 14 days the standard cancellation terms apply.
B.9 Your clients’ data
You retain ownership of the content you upload and of the personal data of clients you bring into the platform. For the personal data of your own clients processed via Bookify Malta, you act as the Data Controller and Bookify Malta acts as your Data Processor. These Terms incorporate by reference the Data Processing Agreement (DPA). You are responsible for ensuring you have a valid lawful basis for processing each client’s telephone number and sending each message. Strictly transactional appointment reminders (confirmations, reschedule notices and the 24-hour reminder) will normally rely on performance of the booking relationship (Art. 6(1)(b)) or your documented legitimate interests (Art. 6(1)(f)), subject to your assessment. Any promotional or mixed promotional message requires compliance with the applicable direct-marketing consent and opt-out requirements. See our SMS Communications Policy for full details.
To deliver the platform we rely on a small number of subprocessors — Google Cloud / Firebase for platform hosting, Epic Communications Ltd (Epic Malta) for SMS delivery, DigitalOcean, LLC for the Bookify-operated SMS messaging relay (hosted in Frankfurt, Germany), and SiteGround Hosting Ltd (SiteGround EU) for email delivery. The public marketing website is hosted on Render (Render.com Inc.) in Frankfurt, Germany. The full, current list, including the purpose, region and transfer mechanism of each subprocessor, is published on our Subprocessor List.
B.10 Accuracy of business information
You are responsible for the accuracy of your listing, including business name, services, prices, opening hours, staff information and location. You agree to only list services you are legally permitted to provide and to hold all required licences, permits and insurance for your business.
B.11 Suspension or termination by us
We may suspend or terminate a business-owner account, without refund of the current billing period, if you materially breach these Terms, if we receive credible reports that you have caused significant harm to clients, if you repeatedly fail to honour bookings, if required to do so by law or court order, or if a payment remains unpaid beyond the grace period in B.5. Where suspension is for a minor or first-time issue, we will give you a reasonable opportunity to remedy it before terminating.
B.12 Directory listings for subscribing businesses
Each subscribing business may appear in the Bookify Directory. Directory presence is opt-in: you decide whether your business is listed and how your profile is presented, and you may withdraw it at any time free of charge (see Part D). A directory profile is separate from your booking page, and unclaimed directory entries for businesses that are not Bookify customers are governed by Part D.
You authorise Bookify to publish the directory information you provide, and you are responsible for its accuracy (see B.10). Bookify may publish and rank your profile in accordance with our Directory Ranking Policy.
Part C — Your clients
Bookify Malta provides each business with its own self-booking page — a web page the business shares with its clients through a link. Clients visit that page, select a service and time, and submit a booking request. Bookify Malta is software the business uses to manage its own appointments; it is not a marketplace where clients browse multiple businesses, and it is not an intermediary, agent or broker between the business and its clients. The business sets its own prices, hours and policies. The agreement for the booked service is between the client and the business directly. Bookify Malta never processes payments between clients and businesses and never takes a commission on individual bookings.
Part D — The Bookify Directory
D.1 What the Directory is
Bookify Malta operates a public directory of salons, barbers and beauty businesses in Malta and Gozo (the “Directory”) at the directory pages on this website. The Directory is separate from the booking software described in Parts B and C. Browsing the Directory does not create an account, a subscription or any agreement between you and Bookify Malta, and it does not make a listed business a party to these Terms merely because a listing exists.
A Directory entry may appear in one of three states: Unclaimed (an independent informational entry), Claimed (an authorised representative has confirmed the entry), or Featured (a business with a working relationship with Bookify Malta — see D.7).
D.2 Unclaimed listings
Bookify Malta may publish limited, factual information about a business that is not a Bookify customer, including its trading name, business category, locality, opening hours where sufficiently reliable, a link to its Google Maps listing, and the date the information was last checked. This information is researched and recorded independently (see the Unclaimed Listings Policy).
An unclaimed listing is not an endorsement, recommendation, verification of licences or quality, partnership, or a representation that the business uses or approves of Bookify Malta. Unclaimed listings carry a prominent notice stating this, and they never include booking functions, contact details, logos, photos, services or prices.
If your business is listed without your involvement and you do not want to be listed, you may request removal free of charge at any time (see D.4).
D.3 Claiming a listing
Claiming a listing confirms that Bookify Malta has taken reasonable steps to establish that the person managing the listing is authorised to represent the business. Claiming is free, does not require a subscription, card details or a sales call, and grants the ability to manage the business’s basic profile facts (name, contact details, logo, photos, opening hours, categories and a short description).
“Claimed” does not mean that the business is licensed, certified, insured, recommended, approved, quality-checked or verified in every factual respect. The verification steps we use are described in our Claim & Ownership Verification Policy.
D.4 Correction and removal
Anyone may submit a correction, legal complaint or safety report. Removal requests will be approved where the requester is the owner, an authorised representative, an affected data subject, a rights holder, or provides another valid legal or factual basis for removal. Corrections and removal requests are free of charge and do not require creating an account or claiming the listing. We operate separate routes for claiming, reporting incorrect information and requesting removal, and we process requests under the targets set out in our Correction & Removal Policy. A completed removal takes effect across the website, sitemaps and internal search, and we retain only a minimal suppression record to avoid accidental re-publication.
D.5 Directory information is provided “as is”
Directory information is compiled from independent, lawfully obtained sources and may change. Each listing shows when its information was last checked, and unclaimed listings may include information the business has not confirmed. Before relying on a listing (for example, opening hours), confirm the details with the business directly. The liability provisions in Part E apply to the Directory, and Bookify Malta is not liable for loss caused by reliance on directory information that is inaccurate, out of date or incomplete, except as required by law.
D.6 How Directory results are ranked
Directory search and browse results are filtered by category, locality (and island) and any search term you enter, and a search term matches the business name. The remaining listings are ordered by status: Featured profiles first, then claimed profiles, then unclaimed profiles. Within the Featured group the order is alphabetical; within the other groups listings keep the order in which they are published in the Directory. Distance, opening status, how recently the information was updated and review counts are not ranking factors in the current version. There is no paid placement currently. A full, plain-language explanation is published in our Directory Ranking Policy.
D.7 Featured profiles
A profile may display a “Featured” label where the business has a working relationship with Bookify Malta. Featured profiles may rank above otherwise comparable unclaimed listings.
Some Featured profiles may have a direct working relationship with or be affiliated with Bookify. Featured status is not an endorsement of a business’s services, licences, qualifications or quality.
D.8 Data protection and the Directory
For directory research, publishing, claims, disputes and removal records, Bookify Malta acts as an independent data controller, and the Data Processing Agreement does not apply to unclaimed directory information. Processing of directory data is described in the Website Privacy Policy (directory section).
A business may access and control the information associated with its own listing, but never another business’s private or internal data. Where a listing identifies a natural person and the information was not obtained from them, we follow the transparency process described in the Website Privacy Policy.
Part E — Liability, disclaimers, indemnity
E.1 Consumer rights are preserved
Nothing in this Part D affects a consumer’s mandatory rights under Maltese or EU law. Where any provision of this Part D is found to conflict with a non-waivable consumer protection, the consumer protection applies and the rest of this Part D continues in effect.
E.2 Service provided “as is”
For business users:the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose or uninterrupted availability.
For consumers: this disclaimer does not apply. Consumer conformity rights under the Digital Content and Services Directive (EU 2019/770) and the Consumer Rights Regulations (S.L. 378.17) apply.
E.3 Limitation of liability — consumers
For consumers, Bookify Malta’s liability for direct, foreseeable loss caused by our breach of these Terms is limited to €500 per claimant, save that this limit does not affect: statutory remedies available under the Digital Content and Services Directive and the Consumer Rights Regulations; liability for fraud, gross negligence, wilful misconduct, or for death or personal injury caused by negligence; or any other liability that cannot be limited under Maltese or EU law.
E.4 Limitation of liability — business owners
For business owners, our total aggregate liability for any and all claims arising out of or related to the Service is limited to the total subscription fees you paid to Bookify Malta in the 12 months immediately preceding the event giving rise to the claim. This limit does not apply to liability that cannot be limited under Maltese law.
E.5 No liability for the business–client relationship
Bookify Malta is not liable for any loss, damage, no-show, cancellation, quality issue, refund dispute, injury or other harm arising from the booking or provision of services between a client and a business. Part C.2 applies.
E.6 Indemnity
If you use Bookify Malta in your commercial capacity, you agree to indemnify and hold harmless Bookify Malta (and Christian Azzopardi trading as Bookify Malta) from any third-party claim arising from your breach of these Terms, your content posted on the Service, or the services you provide to your clients. This indemnity does not apply to consumers. Consumer liability for breach is limited to direct loss reasonably foreseeable as a result of the breach.
E.7 Force majeure
Neither party is liable for failure or delay caused by events outside reasonable control, including acts of God, war, terrorism, civil unrest, strikes, pandemic, government action, power or network outages, or failures of third-party hosting or communications providers.
Part F — General
F.1 Electronic communications
You agree to receive communications from us electronically (email, in-app notifications). Legal notices may be served on you by email to the address on your account.
F.2 Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email to the address on your account at least 30 days before they take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms. If you do not accept the changes, you may cancel your account before they take effect.
F.3 Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
F.4 Entire agreement
These Terms, together with our Privacy Policy, Platform Privacy Policy, Cookie Policy, Cancellation & Refund Policy, Account Deletion Policy, Subprocessor List, the directory policies published on our Trust & Legal centre (including the Unclaimed Listings, Directory Ranking, Claim & Ownership Verification, Correction & Removal, and Content & Intellectual Property policies) and (for business users) Data Processing Agreement, constitute the entire agreement between you and Bookify Malta regarding the Service and supersede any prior agreement on the same subject.
F.5 Assignment
You may not assign or transfer your rights under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition or sale of business assets, in which case we will give you notice.
F.6 Governing law and jurisdiction
These Terms are governed by the laws of Malta, without regard to conflict-of-laws principles. The courts of Malta have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service, save that nothing in this clause prevents a consumer from bringing proceedings in the courts of their EU country of habitual residence as permitted by law.
Where you are a consumer resident in the European Union, this choice of Maltese law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence (Article 6 of the Rome I Regulation).
F.7 Consumer dispute channels
Questions, complaints or requests should first be sent to legal@bookify.mt. If we cannot resolve a complaint, consumers in Malta may contact the Office for Consumer Affairs at the Malta Competition and Consumer Affairs Authority (mccaa.org.mt, Freephone 8007 4400). Cross-border consumer disputes can be addressed through the European Consumer Centre Malta (eccnetmalta.gov.mt).
For data-protection complaints, the supervisory authority is the Information and Data Protection Commissioner of Malta, Level 2, Airways House, Triq il-Kbira, HMR 1100, Floriana, Malta (idpc.org.mt).
